FAQ

New York Sentencing is the best software tool available to prepare a New York State criminal case, providing detailed legal analysis of sentencing alternatives as well as plea bargaining limitations, lesser included offenses, bail and recognizance, and questions of statutory construction.
David E. Woodin, sole proprietor of Due Process Software, created the original DOS-based version of this program (Gunga Clerk) in 1988, redesigned it as a web application (GungaWeb) in 1998, and has released a new version of the program each year for over 30 years. Working behind the scenes for 28 years as sole confidential law clerk to four separate county court judges, Dave amassed nearly three decades of legal knowledge and experience researching literally thousands of criminal cases. Active since 2010 in his own private appellate practice, he continues to devote those skills to maintaining and improving NYSentencing.com, this newest edition of his program.  A graduate of Williams College (cum laude) and Albany Law School, Dave served for four years as an attorney member of the New York Criminal Jury Instructions Committee, for one year as a member of the Subcommittee on Simplification for the New York State Commission on Sentencing Reform, and is the author of several published academic papers on Computers and Law.
Judges, law clerks, prosecutors, public defenders, criminal defense attorneys, probation officers, law librarians, and anyone else who needs timely, accurate and detailed sentencing information, as well as alerts to plea bargaining restrictions, related lesser and greater offenses, statutory definitions, and offense elements.
This fast and easy to use application will give you accurate and up to date sentencing information relevant to your case, without making you wade through impenetrable sentencing charts or track down and parse scattered statutory provisions. If you have multiple cases to research, this program will save you time and money. If you handle only the occasional criminal matter, this program will get you up to speed fast and give you the information you need to level the playing field.
Criminal court chambers across New York State consult it regularly to help determine the legality of proposed case dispositions and ranges of sentencing alternatives. Probation departments use it in connection with pre-sentence investigations and reports. Prosecutors and defense counsel rely upon it in researching and planning case strategies, and to effectively communicate to defendants and clients regarding potential sentencing exposure.
