Note on Scope of Weapons Definitions

With respect to the terms, firearm, rifle, shotgun, machine gun, electronic dart gun, electronic stun gun, cane sword, chuka stick, "kung fu star", the statute's probable reference is to the definitions of these items found in PL 265.00. Note however that the latter statute by its wording limits the scope of the definitions contained therein to terms as used in PL Article 265 and Article 400.

As to the terms, pistol, revolver, billy, blackjack, bludgeon, metal knuckles, sand bag, sandclub, slingshot, shirken, dagger, dangerous knife, dirk, razor, stiletto, imitation pistol, the probable reference is to the same undefined terms as they are used in Article 265, (e.g., PL 265.01).

The terms, dangerous instrument, deadly weapon are defined in PL 10.00 for purposes of their occurance throughout the Penal Law.

The term, "deadly instrument", occurs in PL 120.55, however it is defined nowhere in the Penal Law.
The term, "dangerous or deadly weapon" occurs in PL 265.01(5).
The term, "dangerous or deadly instrument or weapon" occurs in PL 265.01(2).
