Effective 5/22/10, L.2010 c.14 provides:
"Section 1. Section 260.30 of the penal law, as added by chapter 381 of the laws of 1998, is renumbered section 260.31."Which PL 260.30 is to be renumbered?
One is entitled "Vulnerable elderly persons; definitions", and the other §260.30 is entitled, "Misrepresentation by a child day care provider."
Now, Chapter 381 of Laws of 1998 says:
"§3. The penal law is amended by adding a new section 260.30 to read as follows: '§260.30 Vulnerable elderly persons; definitions....'"This is the only §260.30 added by chapter 381.
Therefore, the reference in L.2010 c.14 must be to the section entitled "Vulnerable elderly persons; definitions", which becomes the new PL 260.31.
